The second day of Linda Gibbons’ trial on a charge of obstructing a peace officer in connection with events outside the Scott “Clinic” abortuary in downtown Toronto on July 31, is set for tomorrow, September 23 at 10 a.m. in Room 504 of the College Park courthouse (corner of Yonge and College St.). During the first day of the hearing, September 10th, Gibbons’ lawyer Daniel Santoro argued that the charge of “obstructing a peace officer” is not valid in connection with the July 31 arrest, because Gibbons in no way hindered the official duties of sheriff and police personnel, as is specified in the Criminal Code definition of the charge.
Rosemary Connell of Show the Truth, the pro-life group which uses graphic signs to show the reality of abortion, said that in tomorrow’s trial Gibbons’ lawyers will continue to question the validity of the charge of “obstruction.” Gibbons’ lawyers will also contend that an abuse of process by the Crown attorney’s office has taken place with regard to the “temporary” 1994 injunction which prohibits pro-life activity within 20 metres of the abortion mill’s doors.
“We have known all these years that it is not the right charge and the establishment knows that the real charge of breaking the court order would be a test of its constitutionality,” Connell said.
Pro-life advocates are encouraged to attend the trial tomorrow to support Linda and the two pro-life lawyers representing her.
