Supreme Court Asked Rule on Decisions Against Partial Birth Abortion Ban



The US Bush administration has asked the Supreme Court to make partial-birth abortions illegal.

Three federal appeals courts ruled earlier this year that a ban on the grisly procedure, signed into law by President Bush in 2003, is unconstitutional because it does not make exception for the so-called health of the mother. Planned Parenthood, the ACLU, and several abortionists challenged the law.

Filed Friday, the White House lawyer called the Partial-Birth Abortion Ban a “significant act of Congress that has been invalidated and permanently enjoined by the lower courts.”
