Ave Maria Files Lawsuit Against Obama Administration

Ave Maria University has joined Belmont Abbey College and the Eternal Word Television Network in the rising tide of lawsuits against the Obama administration’s attempt to force contraception, sterilization, and abortion drugs into virtually every health insurance policy in America.

Ave Maria President Jim Towey, former head of the Bush administration’s Office of Faith-Based & Community Initiatives, said, “As an American Catholic, I am in disbelief that I have to choose between being a good Catholic and a good citizen. I will not, and the University will not, accept this false choice.”

Towey said that the university will not allow any President “to force conformance to his or her religious or secular orthodoxy through executive action.”

The Becket Fund for Religious Liberty filed the suit in federal court in Florida.

“The federal mandate puts Ave Maria in a terrible bind,” said Kyle Duncan, General Counsel for the Becket Fund for Religious Liberty, which filed suit this morning on behalf of the University.  “Either it betrays its faith and covers the drugs, or else it ends employee health benefits and pays hundreds of thousands in annual fines.”

Towey said, he is prepared to discontinue the university’s health plan and pay the $2,000 per employee, per year fine rather than comply with an “unjust, immoral” mandate.

    Hey, why doesn’t the Gov’t just mandate that the Prescription Drug
    Manufacturers give birth control pills, other BC devices and
    abortifacient (morning after) pills for free, then everyone will be
    happy, right? then the doctors that perform surgical sterilization can be
    mandated to do it for free and then abortionists can be mandated to abort
    the babies for free

    Why not have an insurance policy that doesn’t cover prescription drugs?  That way, you will not be forced to discriminate against women in your insurance policy: everyone will have no coverage equally.  This is a workplace equality issue, not a religious freedom issue.

    Ave Maria and the other institutions will prevail. This action by the Obama administration in forcing religious based institutions to provide free contraceptive and sterilization services will not stand court scrutiny. The real answer is turing over all insurance to the private market where people can buy any type of policy they want across state lines. The goverment role in regulating and subsidizing health insurance only makes it more expensive and less efficient.

    (Gasp).  What! Are you un-American??  Don’t you know that if the people who “provide” abortion/birth-control services had to give them out for FREE, they would stop doing so?? Are you unaware how this would impact the economy, if all those good, helpful people were suddenly out of work?? (But, to be clear, I speak with irony that the furror is about promoting a lifestyle which feeds directly into a money-making industry — high moral ground on the part of the “liberals”, indeed.)
